I Wrote Trump May Be in Jail on Election Day. But It May Be Even Sooner.
My election analyses in our newsletters have included the unprecedented and even bizarre suggestion that Donald Trump may win the 2024 presidential election while being held behind bars. This is based on one or more felony convictions from the wave of criminal indictments against him that have been handed up by grand juries in Fulton County, GA, Washington DC, New York City, and Palm Beach, Florida.
Whenever a politically biased prosecutor in a solidly Democrat district gets another indictment against Trump, his popularity ratings go up and his chances of winning the election as shown in the polls also go up. With over 90 felony charges pending, and trials underway in anti-Trump jurisdictions, it’s almost guaranteed that Trump will be convicted of something.
Once convicted, the prosecutor and judge can require Trump to go to jail even if he appeals the case. There is no legal or other prohibition on a convicted felon being elected president. So, we are left with the strange prospect of electing Trump as president while he serves time in jail.
Now, in this article, a former Trump lawyer says that Trump may be put in jail even before a conviction. Trump’s ex-lawyer Ty Cobb (a distant relative of the legendary Hall of Fame baseball player of the same name) says that Trump may be jailed for contempt by violating a judge’s gag order.
Federal Judge Tanya Chutkan has imposed a gag order on Trump because of his comments about the case and the judge herself. Trump has violated the gag order already and is probably on good ground contesting the gag order as unconstitutional. But that won’t stop the judge from putting Trump in jail for violating it while Trump’s appeals drag on.
So, I may be right about Trump being in jail on Election Day. But it looks like that jail time may come a lot sooner than I expected.
