If You Don’t Like the Court, Get Rid of The Judges

As children, we probably all encountered at least one situation where someone was losing a board game (Risk was my favorite) and simply wiped the board clean with their arm throwing all the pieces onto the floor and stormed out of the room. That’s a clearcut example of immaturity, selfishness, and bad sportsmanship.

Now, Joe Biden is doing the same thing to the Supreme Court.

Biden and his progressive ideologue associates have suffered a string of defeats at the hands of the U.S. Supreme Court. The case of Trump v. United States gave presidents complete immunity from criminal prosecution for official acts in their core area of responsibility.

The Supreme Court also disemboweled the Deep State by reversing the Chevron deference doctrine in the case of Loper Bright v. Raimondo. The Chevron deference doctrine said that in ambiguous cases, courts should defer to the “expert” judgment of Deep State agencies. Not anymore.

Chevron was overruled and the new rule is that ambiguity must be resolved by the courts. Another case (Fischer v. United States) held that January 6th criminal defendants could not be charged with obstructing official proceedings without further review by the trial court.

The Department of Justice is already dropping those charges from pending cases. SEC v. Jarkesy said that the SEC cannot impose fines by using administrative courts because they deny the defendant the right to a jury trial. These decisions were handed down in rapid fire fashion in the last two weeks of June and early July.

What was Biden’s response? Instead of respecting the law and trying to carry it out, he proposed legislation that would impose term limits on sitting Justices of the Supreme Court.

The legislation would force Clarence Thomas and Samuel Alito, two leading conservative Justices, off the court. It’s a bit like trashing the game and running out of the room.

Instead of respecting the law, Biden wants to end the game or change the rules. This legislation probably won’t go anywhere and Biden’s days as president are now numbered.

Still, it’s emblematic of how Biden and has cronies have completely eroded the rule of law in the U.S.
